Style Coalition and American Living for JCPenney "Made For" Official Sweepstakes Rules.
NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE THE ODDS OF THE ENTRY WINNING
I. Eligibility. The Style Coalition and American Living “Made For” sweepstakes (the “Sweepstakes”) Open to legal residents of the 50 United States and District of Columbia of ages 18 years or older. Sweepstakes is void in the State of Rhode Island and where prohibited by law. The Sweepstakes are subject to all applicable federal, state and local laws, rules and regulations. The Sweepstakes are not eligible to employees, representatives and contractors of Style Coalition, LLC (“Sponsor”), any affiliated companies, prize suppliers, advertising and promotion agencies, the “immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses of such companies (regardless of where they reside). “Household members” shall mean people who share the same residence at least three months a year. By participating in the Sweepstakes through the submission of a comment as described in Section II herein below, you agree to comply with and be bound by these Official Sweepstakes Rules (the “Rules”), administrators and Sponsor of the Sweepstakes, which shall be final and binding in all respects.
II. How to Enter. To enter the Sweepstakes, you must leave a comment (an “entry”) on one of the 10 posts tagged with “American Living for JCPenney” title on the following properties: http://www.WhatIWore.thumblr.com, http://www.StyleBakery.com, http://www.GalaDarling.com, http://www.TheBudgetBabe.com, http://www.The-Coveted.com,http://www.Corporette.com, http://www.StyleMom.com, http://www.SecondCityStyle.com,http://www.CollegeFashion.net, http://www.Clutch22.com (“Participating Properties”). All comments must be submitted between 12:00 a.m. EST on July 15th, 2010 and 11:59 p.m. EST on July 31st, 2010 (the “Entry Period”). There is no limit to the number of comments that you may submit for the Sweepstakes; provided that, each comment complies with the Rules and you may only have one (1) winning entry. Entries using macro, robotic, script or other forms of automatic entry will be disqualified. Entries become the property of the Sponsor and will not be returned. No mechanically reproduced entries permitted. Proof of submission does not constitute proof of receipt. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The Sponsor of the Sweepstakes is not responsible for any late, lost, misdirected, damaged or incomplete entries. The comment(s) submitted by you cannot be offensive or inappropriate, as determined by the Sponsor in its sole discretion. The Sponsor may disqualify comments, without notice, that it deems, in its sole discretion, to be inappropriate or offensive.
III. Winner Selection. Winners will be selected in a random drawing from all the comments submitted in the Sweepstakes in two (2) categories:
(a) 10 (Ten) winners will be awarded U.S. $250.00 JCPenney Gift Card. The winners will be chosen from the entries on Participating Properties” (one winner per property).
(b) 1 (One) Grand Prize winner will be chosen across all Participating Properties,. All potential Grand Prize Winners must fulfill the obligations set forth in Section III herein below.
VI. Grand Prize. One (1) Grand Prize will be awarded in the Contest. The Grand Prize is a JCPenney Gift Card valued at U.S. $1,500.00 (the “Grand Prize”). All federal, state and local taxes that may be owed on the Grand Prize are the sole responsibility of the winner. No transfers or substitution of prizes will be permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value.
V. Odds of Winning. The odds of winning depend on several factors including, but not limited to the number of eligible entries received during the Entry Period.
VI. Notification of Winning. On or about August 2th, 2010, the potential winners will be notified by Sponsor via email to the email address listed in their registered comments account. The return of any prize notification or prize as undeliverable or any other non-compliance with these Rules, as determined by the Sponsor, may result in the forfeiture of the Prize. Prior to receiving the Grand Prize, the potential Grand Prize Winner will be required to execute an Affidavit of Eligibility and Liability Release, IRS Form W-9, and where legal, a Publicity Release, all of which must be returned within fourteen (14) days following attempted prize notification. Failure to comply with the aforementioned time period may result in forfeiture of the Grand Prize.
VII. Winner’s List. The name of the Grand Prize Winner will be made available on the Participating Properties upon termination of the Sweepstakes.
VIII. Internet. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit an entrant from participating in a Sweepstakes if it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.
IXI. Limitation of Liability & General Conditions. Acceptance of the Sweepstakes prize constitutes permission for Sponsor and its agencies (and those acting pursuant to Sponsor’s direction of control) to use winner's name, picture, likeness, biographical information and comment(s) submitted (whether in whole or in part) for advertising, and promotional purposes, worldwide, in perpetuity, in print, broadcast and in any media now known or hereafter developed, including the Internet, without additional consideration and without notification, review or approval, except where prohibited by law.
Participants further agree to release, indemnify and hold harmless Sponsor, administrator(s), affiliates, advertising and promotional agencies, and each of their respective directors, employees, representatives and agents (collectively, “Releasees”), from and against any and all liability for any injuries, loss or damage of any kind, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Grand Prize, participation in the Contest or participation in any Contest related activity. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors or omissions relating to or which may arise in connection with the Contest including, without limitation, errors which may occur in connection with the submission of articles, the administration of the Contest, the announcement of the Grand Prize; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries.
The Sponsor reserves the right, at its sole discretion, to disqualify any individual it determines, in its sole discretion, has tampered with the entry process or the operation of the Contest in any manner or is in violation with these Rules. In the event that Sponsor, in its sole discretion, finds that the Contest is compromised, becomes corrupted in any way or is not capable of running as planned due to unauthorized intervention, fraud, technical failures or any other causes which affect the administration, security, fairness, integrity or proper conduct of the Contest, as determined by the Sponsor in its sole discretion, the Sponsor reserves the right to cancel, terminate, modify or suspend the Contest in whole or in part.
As a condition of entering the Contest, participants agree that under no circumstances will participants be permitted to obtain awards for, and participants hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; all causes of action arising out of or connected with the Contest or Grand Prize awarded shall be resolved individually, without resort to any form of class action; and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event shall participant be entitled to receive attorneys’ fees or other legal costs.
X. Privacy. Registration for Sponsor’s Sweepstakes on “Participating Properties” website is required to enter the Sweepstakes. When you register, we collect personally identifying information about you, including your name, mailing address, and email address. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, PLEASE DO NOT ENTER THIS PROMOTION.
